The Financial Crimes Enforcement Network (FinCEN) has published a new guidance that describes at what point companies and individuals will be considered as money transmitters under the Bank Secrecy Act (BSA) and other laws.
In this case, they must comply with the federal AML and KYC requirements.
Non-custodial wallets, where users have full control of their funds, are not classified as money transmitters.
DEXes that only match orders without settling the funds are not money transmitters.
DEXes that settle trades are money transmitters
DApp developers are not classified as money transmitters.
When DApps perform money transmission, the definition of money transmitter will apply to the DApp, the owners/operators of the dapp, or both.
