On February 22, 2021, the Tokyo District Court issued an order referring the draft rehabilitation plan, which the Rehabilitation Trustee filed with the Tokyo District Court (the “Draft Rehabilitation Plan”), to a resolution, which means that the court issued an order under which creditors may vote for or against the Draft Rehabilitation Plan. We are pleased to inform you that the online voting function has been released on the online rehabilitation claim filing system (the online system) (the “System”).

1. Voting Online Guide
Please login to the System via the URL below, review the relevant materials, such as the Draft Rehabilitation Plan, and vote for or against the Draft Rehabilitation Plan in accordance with the on-screen guidance.

The deadline for voting online is October 8, 2021 (Japan Time). Therefore, please complete your vote before the deadline. You can also see the amount of your voting rights on the System.

The Draft Rehabilitation Plan and the relevant materials uploaded on the System are also accessible on the website for viewing documents for creditors, which is accessible via the URL below.

Although the documents uploaded on the System or on the website for viewing documents for creditors can be downloaded (with some exceptions), they are available only to creditors. Accordingly, please refrain from providing, disclosing or leaking such documents to third parties.

2. Registration on System
Creditors who have yet to register on the System, or who have forgotten their login information, such as passwords, can access the URL below, and follow the on-screen guidance to register (re-register) on the System.

In addition to voting online for or against the Draft Rehabilitation Plan, it is anticipated that the System will be used by creditors for procedure for receiving repayments in the future. Therefore, we request those creditors who have yet to complete the online registration to do so.

3. Requirements for Approval of the Draft Rehabilitation Plan, etc.
In order for the Draft Rehabilitation Plan to be approved, both of the following are required:
i. The agreement of a majority of the number of voting rights holders voting on the Draft Rehabilitation Plan; and
ii. The agreement of not less than one half of the total amount of the voting rights holders.

If you do not vote, you will be deemed to have voted against the Draft Rehabilitation Plan for the requirement of the amount of the voting rights.

Upon approval of the Draft Rehabilitation Plan and the Tokyo District Court’s confirmation order becoming final and binding, the Rehabilitation Plan will become effective, and repayments will be made in accordance with the Rehabilitation Plan.

4. Information about Voting Form and Online Voting Recommendations
The voting form and other documents will be mailed to creditors with voting rights to their addresses provided in the proofs of claims that they filed (if they applied for a change of their address and such application was approved by the Rehabilitation Trustee, the materials above will be sent to such changed address). If you vote online on the System, you may vote even before you receive the voting form. Once you have voted online, you are not required to vote using a voting form (i.e., please refrain from voting twice). If you are a creditor with voting rights who has registered on the System, please vote online.

1. はじめに
本メールは、株式会社MTGOX（以下「MTGOX」といいます。）取引所のユーザーであった可能性のある方のうち、MTGOXの破産手続（東京地方裁判所平成26年（フ）第3830号）及び民事再生手続（東京地方裁判所平成29年（再）第35号。以下「本民事再生手続」といいます。）において、一度も債権届出等の手続参加の意思表明（債権届出や異議に関する査定申立ての意思の表明）をされていない方を対象に送信しております。非常に重要なメールですので最後までお読みください。また、本メールの内容に関して、MTGOXのホームページにもアナウンス文を掲載しておりますので、併せてご参照ください。

2. 本民事再生手続及び貴殿/貴社の債権の状況
現在、MTGOXについては、日本国の法令に基づき本民事再生手続が行われており、当職が再生管財人として、東京地方裁判所の監督のもと、管財業務を行っております。

MTGOX取引所のユーザーを含む債権者の皆様が債権の弁済を受けるためには、認められた債権を保有し、本民事再生手続にご参加いただく必要があります。本民事再生手続にご参加いただくには、原則として日本国の法令に従った債権届出書の提出が必要ですが、貴殿/貴社からは提出期限内に債権届出書の提出がなされませんでした。

もっとも、再生管財人は、日本国の法令に基づき、2019年3月にMTGOXのデータベースに記録された、貴殿/貴社のアカウントの残高どおりに、貴殿/貴社の債権を認めました。
しかし、その後、MTGOXの他の債権者（以下「異議者」といいます。）から、日本国の法令に基づき、貴殿/貴社の債権を認めることに対して異議が出されました。これに対し、貴殿/貴社からは、所定の期限までに異議に反対する特段の意思表明（再生管財人からの異議通知メールへの所定の意思表明等）がなされず、異議撤回がなされていないため、貴殿/貴社の債権は認められていない状態、すなわち、再生計画に基づく弁済を受けられない状態となっております。

3. 本民事再生手続への参加希望の受付
しかしながら、現在、再生管財人は、貴殿/貴社から本民事再生手続への参加の意思表明を受けた場合には、再生管財人から異議者に対して、異議の撤回を打診することを検討しております。異議者により異議が撤回されれば、貴殿/貴社の債権は認められることになりますので、所定の手続を経た上で、再生計画に基づく弁済を受けることが可能となります（※なお、異議者により異議が撤回された場合であっても、貴殿/貴社が、異議の撤回後に所定の手続を経なかった場合には、再生計画に基づく弁済を受けられないおそれがございます。）。
つきましては、本民事再生手続への参加を希望される方は、2021年9月24日（日本時間）までに、以下の文言をメール本文に記載の上、本メールに返信してください。

「私は本民事再生手続への参加を希望します。」

※2021年9月24日（日本時間）までに上記返信がなされなかった場合には、再生管財人から異議者に対して、貴殿/貴社の債権に対する異議の撤回を打診することは致しかねますのでご留意いただきますようお願い申し上げます。

※本民事再生手続参加の意思表明は必ず本メールに返信する形で行ってください。別のメールアドレスから返信された場合には、貴殿/貴社を債権者と認めることができず、本民事再生手続への参加希望を受け付けかねますので、予めご了承ください。

※貴殿/貴社の債権への異議を撤回するか否かは、異議者に権限があり、異議者が判断いたします。再生管財人は、貴殿/貴社が本メールに上記返信をした場合、異議者に対して異議の撤回を打診いたしますが、再生管財人は異議の撤回に関して何ら権限を有しておらず、本メールへの上記返信をもって貴殿/貴社の債権が認められることを約束・保証するものではありませんので、ご理解いただきますようお願い申し上げます。

4. 貴殿/貴社の債権残高の確認方法
貴殿/貴社の債権残高については、異議者による異議が撤回された後に個別にメールにてご連絡することを検討しておりますが、現状以下の方法でも残高照会を行うことが可能です。

(1) MTGOXのホームページの残高照会機能を利用する方法
MTGOXのホームページに設置された「MTGOXのデータベースに記録されたアカウントの残高を照会する方はこちら」のボタンから残高照会ページにアクセスの上、MTGOXに登録したUsername/e-mailとPasswordをそれぞれ入力してください。

(2) FAQから問い合わせる方法
上記(1)の方法で債権残高を確認できなかった方は、MTGOXのホームページのFAQのお問い合わせフォームからご照会ください。その際、お問い合わせフォームの「ご用件」の項目は「認否結果照合」を選択し、必要事項を入力の上、照会してください。

5. その他のお問い合わせ
本民事再生手続に関するより詳細な情報は、MTGOXのホームページに掲載した各種アナウンス文及びFAQをご参照下さい。

1. Introduction
This email is being sent to those who may have been users of the MtGox Co., Ltd. (hereinafter referred to as “MtGox”) exchange and who have not expressed an intention to participate in the MtGox bankruptcy proceedings (Tokyo District Court 2014 (fu)No. 3830) and rehabilitation proceedings (Tokyo District Court 2017 (sai) No. 35; hereinafter referred to as “the Rehabilitation Proceedings”), such as by filing a proof of claim (e.g., filing a proof of claim or an expression of intention to file an assessment of claim against an objection).This is an extremely important notice, therefore, please read it carefully. Additionally, please refer to the announcement concerning this notice on the MtGox Homepage.

2. Status of the Rehabilitation Proceedings and Your Claim
Currently, the Rehabilitation Proceedings for MtGox are being carried out in accordance with the Laws and Regulations of Japan, and, as a rehabilitation trustee, I (hereinafter referred to as “Rehabilitation Trustee”) am discharging the duties of trustee of MtGox under the supervision of the Tokyo District Court.

In order for the creditors, including users of the MtGox exchange, to receive repayment of claims, it is necessary to have approved claims and to participate in the Rehabilitation Proceedings.In principle, in order to participate in the Rehabilitation Proceedings, it is necessary to file proofs of claims in accordance with the Laws and Regulations of Japan; however, you did not file proofs of claims within the deadline.

The Rehabilitation Trustee has approved your claims recorded in the MtGox database in March 2019, with the outstanding balance in your account in accordance with the Laws and Regulations of Japan.
However, other creditors of MtGox (hereinafter referred to as the “Disputing Parties”) have subsequently objected to the approval of your claims. In addition, as you did not express any specific intention to deny such objection (such as expression of intention in reply to the e-mail notice of objection from the Rehabilitation Trustee in a prescribed manner) by the deadline and the objection has not been withdrawn,currently your claim is not approved; i.e., you are not entitled to receive repayment based on the rehabilitation plan.

3. Receipt of Expression of Intention to Participate in the Rehabilitation Proceedings
However,the Rehabilitation Trustee is currently considering asking the Disputing Parties to withdraw their objection upon the Rehabilitation Trustee’s receipt of your expression of intention to participate in the Rehabilitation Proceedings.If the objection is withdrawn by the Disputing Parties, your claims will be approved, and, after the prescribed proceedings, you will be able to receive repayment based on the rehabilitation plan. (*Even if the Disputing Parties withdraw their objection, in the case where you do not follow the prescribed proceedings after the withdrawal of the objection, you may not be able to receive repayment based on the rehabilitation plan).
If you wish to participate in the Rehabilitation Proceedings, please reply to this email by September 24, 2021 (Japan Standard Time), writing the following sentence in the body of the e-mail.

“I would like to participate in the Rehabilitation Proceedings.”

*Please note that, if you do not send such reply by September 24, 2021 (Japan Standard Time), the Rehabilitation Trustee will not ask the Disputing Parties to withdraw their objection to your claim.

*The intention to participate in the Rehabilitation Proceedings must be expressed by your replying to this e-mail. Please note that, if you reply from a different e-mail address, the Rehabilitation Trustee can neither recognize you as a creditor, nor recognize such reply as your intention to participate in the Rehabilitation Proceedings.

*It is the Disputing Parties who have the authority to decide whether or not to withdraw their objection to your claim and who will make the decision.The Rehabilitation Trustee will ask the Disputing Parties to withdraw their objection upon receipt of your reply to this e-mail; however, the Rehabilitation Trustee has no authority regarding the withdrawal of the objection andcannot promise or guarantee to have your claim approved upon your replying to this e-mail.

4. How to confirm the outstanding balance of your claim
Regarding the balance of your claim, the Rehabilitation Trustee is considering contacting you individually by e-mail after the objection by the Disputing Parties has been withdrawn; however, you can also now inquire about the balance of your claim via the following procedures:

(1) Using the balance inquiry function on the MtGox Homepage
Access the balance inquiry page by clicking the button “Please click here to inquire the wallet balance of your account recorded in the MTGOX database” on the MtGox Homepage and enter the username/e-mail and password registered with MtGox.

(2) Inquiring through the FAQs
If you were unable to confirm the outstanding balance of your claim by (1) above, please inquire through the Inquiry Form in the FAQs on the MtGox Homepage. In sending the Inquiry Form, select “Retrieve result of approval or disapproval of proof rehabilitation claim” in the “Inquiry” column in the Inquiry Form and enter the necessary items.

For more information on the Rehabilitation Proceedings, please refer to announcements and FAQs posted on the MtGox Homepage.
